An L.A. judge on Thursday denied <\/span>Paula Patton\u2018s request to limit her ex-husband <\/span>Robin Thicke\u2018s joint custody of their 6-year-old child, <\/span>Julian, after she accused him of physical abuse.<\/p>\n

\u201cThe judge denied all of Paula\u2019s requests for custody,\u201d a source close to the situation tells PEOPLE. \u201cShe wanted more custody because of her allegations of physical abuse, which are untrue and unfounded.\u201d<\/p>\n

Reps for Thicke, 39, and Patton, 41, have not responded to requests for comment.<\/p>\n

In legal documents obtained by PEOPLE, Patton claims she\u2019s \u201cbecome concerned about \u2019s drinking and drug use, as well as the forms of punishment he is using to discipline Julian\u201d over the past year.<\/p>\n

Patton claims after Julian showed her how Thicke spanked him, she responded with an \u201cow,\u201d and added that \u201cJulian said it was worse than that,\u201d according to the outlet.<\/p>\n

According to the document, the former couple\u2019s physical custody agreement gives Thicke overnights with Julian every Thursday, Friday and Saturday. The pair\u2019s <\/span>divorce was officially granted <\/span>last March after a <\/span>year-long separation.<\/p>\n

In his declaration, Thicke claims Paula \u201cholds residual anger\u201d towards him because he and his family \u201cwould not permit her or her family\u201d to <\/span>attend the funeral <\/span>of his late father, <\/span>Alan Thicke.<\/p>\n

\u201cPaula did not have a positive relationship with my father and often made negative comments to me about my father,\u201d says Thicke in the legal doc. \u201cAs such, she was not welcome at his funeral. It is my belief that Paula only wanted to attend because it would have resulted in additional public exposure for her.\u201d<\/p>\n

Saying he has \u201con a very rare occasion, and only as a last resort,\u201d used \u201clight spanking\u201d with Julian per his agreement with Patton during their marriage, Thicke insists he has \u201cnever exceeded age-appropriate discipline.\u201d<\/p>\n

In his declaration, Thicke claims he has not had physical contact with Julian since Dec. 31, and that after Julian\u2019s first day back at school on Jan. 3, Patton refused to let father and son FaceTime in private.<\/p>\n

Two days later, Patton allegedly told Thicke that Julian had informed school officials he had been spanked and that he was \u201cscared\u201d of his dad. The school principal told Thicke on Jan. 6 a report had been made to L.A.\u2019s Department of Children and Family Services. (DCFS declined to comment citing client privacy.)<\/p>\n

Patton claims in her declaration that the school\u2019s principals \u201cadvised\u201d her about \u201ccomments and statements Julian made to them about the way Respondent hits and punishes in private.\u201d The actress adds that she told them she \u201chad been hearing the same things, and that I did not know how to handle and was very concerned.\u201d<\/p>\n

Patton adds that Julian\u2019s \u201cbehavior has become very concerning,\u201d and that the child has \u201cbecome very tense,\u201d disappears into \u201cwhat appears to be a trance\u201d and has developed a \u201cslight stutter.\u201d<\/p>\n

According to Thicke, Patton refused to let him speak to Julian \u2014 despite repeated attempts to call or FaceTime \u2014 until Jan. 9, when \u201cPaula finally called me.\u201d<\/p>\n

\u201cWe spoke for a couple of minutes during which time I told him that I loved him, everything will be ok, he had done nothing wrong, and that I was excited to see him later in the week,\u201d says Thicke in the declaration.<\/p>\n\n
