{"id":57505,"date":"2018-12-13T01:45:34","date_gmt":"2018-12-13T01:45:34","guid":{"rendered":"https:\/\/www.thefastfashion.com\/?p=57505"},"modified":"2018-12-13T01:47:01","modified_gmt":"2018-12-13T01:47:01","slug":"brooklyn-model-awarded-125000-unknowingly-became-face-hiv","status":"publish","type":"post","link":"https:\/\/www.thefastfashion.com\/?p=57505","title":{"rendered":"Brooklyn model awarded $125,000 after she unknowingly became face of HIV"},"content":{"rendered":"<p>A Brooklyn model has been awarded $125,000 after&nbsp;she unwittingly became the face of HIV&nbsp;when a state agency used her stock photo in an ad campaign.<\/p>\n<p>A perfectly healthy Avril Nolan had been seeking $1.5 million from the Division of Human Rights for using her face in newspaper spots with the words, \u201cI am positive\u201d and \u201cI have rights\u201d for its 2013 public health campaign.<\/p>\n<div class=\"e3lan e3lan-in-post1\"><\/div>\n<p>When Nolan, who is in her 20s and is also a PR rep, learned from a friend\u2019s Facebook post about the ad \u2014 and her photo in it \u2014 she was \u201ccompletely shocked\u201d and \u201csick to the bottom of her stomach\u201d thinking that her friends, employer, clients, exes and future boyfriends might see it, according to court papers.<\/p>\n<p>In fact, one co-worker came up to her and gave her a hug, then asked, \u201cOh, will I catch something?,\u201d Nolan testified.<\/p>\n<p>Another co-worker sent her a \u201cHappy World AIDS Day\u201d email, she said.<\/p>\n<p>Court of Claims Judge Thomas Scuccimarra found that Nolan \u201csuffered emotional distress and humiliation during the immediate aftermath of the publication and for some time thereafter; however, there is no basis for an award of future damages.\u201d<\/p>\n<div class=\"unruly_in_article_placement\" data-unruly-ad-type=\"horizontal\">\n<div class=\"unruly_ia_furniture\">\n<div class=\"unruly_ia_disclosure\">&nbsp;<\/div>\n<\/div>\n<div class=\"unruly_in_article_video_container\">&nbsp;He noted that she\u2019s not in counseling and has a thriving vintage clothing business.
