The Florida teen who made a name for herself as the \u201cCash Me Outside\u201d girl is taking three gaming companies to court for using her signature phrase and voice in their new mobile apps, according to reports.<\/p>\n
Danielle Bregoli, 14, her mother, Barbara Ann, and their company, Dani B Holdings LLC, filed a trademark lawsuit Thursday against the companies and people who developed and published the apps \u2014 named Cash Me Outside and How Bout Dat \u2014 under Anonymous Games Inc., <\/span>according to the suit obtained by the Palm Beach Post.<\/p>\n The Bregolis seek at least $1 million in damages in the suit, filed in South Florida federal court, the paper reported. The mother and daughter argue that they are entitled to all of the gross revenue received directly or indirectly from the game.<\/p>\n The complaint accuses Anonymous Games Inc., its former and current owners Josiah Jenkins and Matthew Gruettner, respectively \u2014 as well as two other companies, Appnoxious LLC and Squad Social LLC.<\/p>\n It calls the Cash Me Outside app an \u201cexceedingly simple and completely unoriginal game\u201d that is free but draws its revenue from ads and \u201cin-app purchases,\u201d according to the paper. The app also uses Bregoli\u2019s voice uttering her signature phrase and uses an avatar resembling her, the complaint says.<\/p>\n A search of the iTunes app store reveals that Anonymous Inc. changed the app\u2019s name to Get Cash Outside. The app also removed Bregoli\u2019s catchphrase and replaced it with the words, \u201cThat\u2019s Lit,\u201d the Palm Beach Post reported.<\/p>\n \u201cThe reason why we had to change the beat is because the Cash Me Outside girl threatened to sue,\u201d a woman who identified herself as Mrs. Snyder from Anonymous Inc. wrote on the app store page. \u201cWe\u2019re trying to get her to let us change it back but it may not work but we will work hard and thank you for all the comments that are helping us fix it.\u201d<\/p>\n The game involves making the character jump over obstacles to collect bands of cash, according to its description on the page.<\/p>\n The How Bout Dat app has been removed.<\/p>\n The complaint says Bregoli\u2019s reps came to an oral agreement with Jenkins back in February that Anonymous Inc. would pay them $75,000 \u2014 as well as a 50 percent revenue split on the first game.<\/p>\n Following that conversation, Jenkins \u201crepeatedly made excuses for his delay\u201d and stopped responding to phone calls, according to the complaint.<\/p>\n A little over a week later, the second app was published.<\/p>\n Once Bregoli\u2019s reps threatened to pursue legal action against the company, Gruettner emailed them, saying he was the actual developer of the Cash Me Outside app and Jenkins was his former business partner, the complaint says.<\/p>\n Gruettner claimed he owned the \u201ccode and assets\u201d for the game and wanted to come to an agreement with Bregoli and her company \u2014 but then he too broke off communications, the complaint alleges.<\/p>\n Gruettner told the Palm Beach Post he is the sole owner of Anonymous Games and that all other companies named in the complaint \u2014 as well as Jenkins \u2014 were never involved.<\/p>\n He said he expects the case will be dismissed because the app was approved on Jan. 27, well before Bregoli\u2019s company filed a trademark for \u201cCash me ousside how bow dat\u201d on May 3.<\/p>\n He claimed he never filed for a trademark for the game because he usually makes games based on trending topics \u2014 and that he changed the name of the game once he learned the family had trademarked Bregoli\u2019s catch phrase.<\/p>\n \u201cThe truth will come out in court as we intend to fight any accusations to the fullest extent,\u201d he told the paper.<\/p>\n The sassy teen gained internet fame after she and her mom appeared last year on a \u201cDr. Phil\u201d episode titled \u201cI want to give up my car-stealing twerking 13-year-old daughter who tried to frame me for a crime.\u201d She uttered her infamous line \u2014 \u201cCash me outside, how bow dah\u201d \u2014 as audience members jeered at her.<\/p>\n Adv<\/em>.<\/strong><\/p>\r\n\r\n Since the episode went viral, Bregoli made headlines for other instances of wild behavior, <\/span>which included punching a passenger aboard a Spirit Airlines plane.
