(Photo: Getty Images)<\/figcaption><\/figure>\n<p>Now a San Francisco-based fashion company, Modern Appealing Clothing,&nbsp;is suing the Ivanka Trump label over \u201cunfair competition.\u201d<\/p>\n<p>In the lawsuit, filed&nbsp;in San Francisco Superior Court on Thursday, the 40-year-old brand&nbsp;alleges the Trump clothing and accessories label has gained an unfair advantage \u201cfrom Donald J. Trump being the President of the United States and from Ivanka Trump and her husband, Jared, working for the President of the United States.\u201d&nbsp;Yahoo Style has reached out to the Trump brand for comment and will update with any response.<\/p>\n<p>The company also accuses the brand of profiting off of its association to the White House, as well as the unlawful marketing practices of&nbsp;government officials, including the counselor to the president,&nbsp;Kellyanne Conway, and even President Trump himself.<\/p>\n<p>Modern Appealing Clothing says the label is&nbsp;guilty of \u201cexploiting the power and prestige of the White House for personal gain, including, but not limited to, piggy-backing promotion of defendant Ivanka Trump products on appearances at executive branch and other governmental events.\u201d<\/p>\n<p>The lawsuit cites President Trump\u2019s tweet slamming Nordstrom for dropping the Ivanka Trump label as an example of unlawful promotion.<\/p>\n<div class=\"box shadow  \"><div class=\"box-inner-block\"><i class=\"fa tie-shortcode-boxicon\"><\/i>\n\t\t\t\n<blockquote class=\"twitter-tweet\" data-lang=\"en\">\n<p dir=\"ltr\" lang=\"en\">My daughter Ivanka has been treated so unfairly by <a href=\"https:\/\/twitter.com\/Nordstrom\">@Nordstrom<\/a>. She is a great person &#8212; always pushing me to do the right thing! Terrible!<\/p>\n<p>\u2014 Donald J. Trump (@realDonaldTrump) <a href=\"https:\/\/twitter.com\/realDonaldTrump\/status\/829356871848951809\">February 8, 2017<\/a><\/p><\/blockquote>\n<p><script async=\"\" src=\"\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n\t\t\t<\/div><\/div>\n<p>Kellyanne Conway\u2019s highly controversial act of endorsing Ivanka Trump\u2019s products on<em>&nbsp;Fox &amp; Friends&nbsp;<\/em>in early February is also described in the lawsuit as unfair promotional activity.<\/p>\n<p>After the incident, White House press secretary Sean Spicer said during his daily briefing that Conway had \u201cbeen counseled on that subject, and that\u2019s it.\u201d The suit also claims Spicer has used his position&nbsp;to endorse the Ivanka Trump label.<\/p>\n<p>Modern Appealing Clothing argues that the brand fails \u201cto take appropriate steps to avoid exploiting public office for private gain,\u201d which&nbsp;will help the company to continue to increase its sales.<\/p>\n<p id=\"yui_3_18_0_4_1490143827000_3271\">The lawsuit seeks unspecified damages and an order preventing the Ivanka Trump brand from being sold in California.<\/p>\n\n<div style=\"font-size: 0px; height: 0px; line-height: 0px; margin: 0; padding: 0; clear: both;\"><\/div>","protected":false},"excerpt":{"rendered":"<p>Ivanka Trump&nbsp;may have publicly disassociated herself from her clothing and accessories label by announcing&nbsp;a formal leave of absence in January \u2014 but some retailers feel the label is still profiting from her name and influence.
